Proposed new legislation, currently before the Welsh Assembly, will extend the period of notice of eviction that landlords are required to give their tenants.
Outlining the Bill – the Renting Homes (Amendment) (Wales) Bill – on the 12th of February, Landlord Today explained that landlords in Wales will be required to extend the period of notice they must give any tenant from the present two months to six months.
ARLA Propertymark has already expressed alarm at the proposals. The lobby group for landlords complains that the minimum six-month delay between issuing a notice of eviction and final repossession will send further “shockwaves” through a currently nervous private rental sector in the Principality.
The process of eviction is already fraught with inconvenience, delay and expense as landlords try to regain possession of their property through the courts. The proposed new legislation will only make those difficulties still more difficult and costly.
The pressure group warns that many landlords may become so apprehensive about delays in evicting tenants that they avoid the risks by selling up. This will reduce the availability of private rented property at a time when there is already a dire shortage of such accommodation.
Meanwhile, as we reported in June last year, four in every ten landlords in both England and Wales have indicated that they will think about selling their buy to let property if the government goes ahead – as it has promised – with plans to repeal Section 21, fast-track and so-called “no-fault” evictions. With the repeal of this current avenue for repossession, landlords would instead be forced into costly and lengthy court action.
